Piedad Bassiti: It is my hope that the California case will make it to the US Supreme Court. The ban was passed by a majority vote, but can still be challenged in the California Supreme Court and if the California court refuses to override the vote on constitutional grounds, the appeal would then go to Washington. If the US Supreme Court rules that the ban violates the US Constitution, the legal precedent will be set by which all states will eventually fall into line.
Newton Fedorko: Currently, the only state that has same sex marriage is Massachusetts. In 2002 there was a ballot drive to put it to a popular vote, but opponents were un! able to gather enough signatures and it was later revealed that many signatures were obtained fraudulently by telling signers that they were signing for a ballot initiative banning the slaughter of horses for food and not a ballot against same sex marriage.In October 2006, the New Jersey State Supreme Court ruled that preventing same sex couples from access to the rights and responsibilities enjoyed by opposite sex couple was unconstitutional, and gave the state legislature 180 days to "Expand the definition of marriage to include same-sex couples, or create a civil union type system that is similar to marriage, without the name "marriage.""The states of Vermont and Connecticut do not have same sex marriage, but do have civil unions which have similar but not identical rights of marriage.
